En este artículo se realiza un recorrido cronológico por las propuestas teóricas y experimentos que condujeron a la constitución del denominado principio de complementariedad, enunciado por Bohr. Se muestra como a dicho principio subyacen dos modelos clásicos (ondulatorio y corpuscular) que se toman como analogía para describir y predecir fenómenos de carácter cuántico. Dichos modelos son excluyentes en ambos ámbitos, clásico y cuántico; no obstante, los fenómenos cuantizados requieren la aplicación – aunque no simultánea - de ambos para conseguir un (...) tratamiento completo. La cuestión es si esta extrapolación de modelos, más allá de su adecuación instrumental, puede considerarse cercana a la realidad. (shrink)

Im Lichte von theoretischen Überlegungen zur „symbolischen Grenzziehung“ und „Zugehörigkeit“ werden Ergebnisse aus Fallstudien in Nordrhein-Westfalen und Baden-Württemberg präsentiert.

The role played by witnesses of bullying in nursing settings remains little studied, despite their potential relevance in explaining the onset and development of bullying. The objective of this study was to develop a model to account for witnesses’ intention to help and helping behaviour in response to bullying in a nursing setting. Three hundred and thirty‐seven witnesses completed self‐report measures of variables predicting intention to help and helping behaviour. A full structural model was constructed using structural equation modelling. The (...) intention to help victims was elicited by tension, group identity, support to peers’ initiative to intervene and absence of fear of retaliation. However, engagement in helping behaviour was only predicted by the absence of fear of retaliation. This study shows that witnesses of bullying in nursing settings do not remain impassive, but their experienced discomfort and intention to help victims is not sufficient to predict helping behaviour. Fear of possible retaliation if intervening in favour of victims constitutes a crucial factor explaining witnesses’ hesitation to help victims. Several implications for the implementation of policies directed at eradicating bullying in nursing settings are discussed. (shrink)

Husserl has often stood accused of Eurocentrism given his disquieting coupling of philosophy as universal science with Europe. And yet, however much this accusation has clouded the appeal of transcendental phenomenology, the nature of this charge remains obscure: whether Husserl’s chauvinism is merely a personal opinion punctuating his writing or is instead closely connected to the methods of phenomenology has been left unexplored. This paper offers itself as a corrective, looking to get a clearer picture of how precisely Eurocentrism afflicts (...) transcendental phenomenology. The overarching aim of doing so is to chart the possibilities for the development of a non-Eurocentric, decolonial phenomenological thinking which exploits the enduring appeal of Husserl’s commitment to presuppositionlessness. The first part of the paper considers the relationship between the phenomenological reduction and eidetic variation, showing that, by Husserl’s own lights, phenomenological science seeks to expel all forms of prejudice. Part two, however, shows that the entrance of Eurocentrism into phenomenology is not simply accidental, in two distinct senses. The first, which takes off from Merleau-Ponty’s (implicit) critique of Husserl, argues that Husserl in his late work is insufficiently attentive to the empirical dimension: Eurocentrism thus stems from the overly transcendental emphases of this project and its inability to engage with concrete human diversity. The second draws on Derrida’s (explicit) critique of Husserl, arguing that it is precisely the admission of concrete historico-cultural facts into phenomenology that compromises the universal by identifying it with the particularities of Europe. I thus show that Eurocentrism does indeed insinuate itself in Husserl’s methods—_not_, however, in a manner that renders transcendental phenomenology irredeemable. Given the opposition between these two insightful criticisms, however, I argue that the challenge for a decolonial vision of phenomenology is formidable. (shrink)

This research aims to describe how practicing lawyers perceive ‘plain writing’ in the legal field and to conceptualize this notion through the discourse analysis of these specialists. To do so, a qualitative research framed in the interpretive paradigm has been developed. Specifically, 18 practicing lawyers, from different countries and with different specializations in the practicing of Law, were surveyed. After analyzing the discourse of the interviewed lawyers, eight macro categories accounting for plain language both generally and particularly were identified. The (...) audience was identified as a key element in the production of legal texts which facilitate justice to citizens. Based on our analysis, we conclude with a definition of plain writing. This essay examines how hermeneutic philosophy, particularly Gadamer's, recovers rhetoric, less as the art of speaking well than as a statement of a truth of the sensus communis, that which communicates veracious content through argumentation. This is the sense in which Gadamer acknowledges the ubiquity of rhetoric and hermeneutics as components of linguisticity (Sprachlichkeit). Conceived in the context of non-methodical wisdom and phronesis, Gadamer's rehabilitated rhetoric is concerned with pragmatics and ethics. Rhetoric is no longer viewed as a technique of (...) verbal manipulation and becomes relevant for dialogic communication. Gadamer thus joins the Habermasian criticism of formalized reason that is detached from values. Both of them reject instrumental reason, because it has colonized communicational reason. However, since Gadamer's view of rhetoric has also been criticized by Habermas and Ricoeur their objections cannot be overlooked in a discussion of his hermeneutics. The essay concludes with a brief consideration of the implications of the debate on rhetoric, hermeneutics, and communication for the twenty-first century. (shrink)

El propósito es dilucidar en qué medida ambas producciones comparten una situación de hermanamiento con otras manifestaciones como la literatura y el cine. Así pues, tomando como caso de estudio estos dos géneros de videojuego y cómic, respectivamente, el presente trabajo aborda las implicaciones derivadas de su ambigüedad definitoria y la dificultad de delinear para ellos parcelas clasificatorias estables. En este trabajo se intentan mostrar algunas tensiones entre el discurso de la conservación, el multiculturalismo y los prejuicios racistas, tomando como punto de referencia el caso de los Montes de María en el Caribe colombiano, donde han tenido lugar proyectos de cooperación a propósito de la biodiversidad y existen iniciativas locales para su conservación. Se describen tres niveles en los que pueden encontrarse los prejuicios racistas en el discurso de la conservación, y las tensiones que los caracterizan, asociadas tanto (...) a las ideas de resistencia y de comunidad, como a la necesidad de corrección de las prácticas por parte de quienes habitan los bosques. El propósito de estas reflexiones es cuestionar el discurso de la conservación y el multiculturalismo para ampliar las perspectivas frente a las apuestas por la conservación y las luchas étnico-campesinas que se llevan a cabo en la alta montaña de los Montes de María, similares seguramente a otros casos en América Latina. ResumenLa autora introduce al lector en la sociofenomenología de la vida cotidiana de A. Schütz desde una lectura hermenéutica de “El Quijote”. Se detiene en el análisis schütziano de las estructuras de relevancias presentes en el universo quijotesco, ilustrando con citas de la obra de Cervantes y comentarios de las mismas las diversas construcciones sociales de los mundos de la vida habitados por los diferentes personajes, principalmente por Don Quijote y Sancho. Las articulaciones de estas realidades múltiples van aclarando el (...) sentido del subuniverso quijotesco y el lugar del mismo en el seno del mundo de la vida compartido. Esas articulaciones se traducen en diferentes relaciones intersubjetivas que van reconfigurando el mundo social de don Quijote. The articulations of these multiple realities go clarifying the sense of the quixotic subuniverse and its place in the common lifeworld´s bossom. Such articulations are translated into different intersubjetive relationships which reshape the Quixot´s social world. Testifying subjected to hermeneutical injustice. Sexual harm and discernment Resumen: Junto a la concepción del testimonio como institución social sometida a condiciones y normas, hay en Conocimiento expropiado (Broncano 2020) una segunda forma de concebir la práctica epistémica del testimonio que entra en conflicto con la primera y que parece pasar inadvertida. Esta segunda concepción se manifiesta en el modo en que Broncano delimita el acto de testimoniar y la dependencia epistémica. El objetivo de esta contribución es mostrar el conflicto (...) existente entre ambos modos de concebir el testimonio a partir de la tensión interna que presentan: mientras que la concepción del testimonio como institución social nos permite reconocer algunas formas fundamentales de testimonio (a saber, el testimonio de las víctimas de injusticia hermenéutica), las definiciones del acto de testimoniar y de la dependencia epistémica parecen excluirlas. Lejos de invalidar el análisis de Broncano, la tensión interna, aunque problemática para los casos en los que quien testimonia está sometida a la injusticia hermenéutica es, en primer lugar, necesaria para comprender los casos de injusticia discursiva o injusticia testimonial —y, por lo tanto, no defiendo su rechazo?; y, en segundo lugar, pone de relieve la importancia vital de concebir el testimonio como una institución social. Abstract: Alongside the conception of testimony as a social institution subject to conditions and norms, there arises in Conocimiento expropiado (Broncano 2020) a second way of conceiving the epistemic practice of testimony that conflicts with the first and seems to go unnoticed. This second conception is manifest in the way Broncano delimits the act of testimony and the epistemic dependence. The aim of this contribution is to show the conflict between these two ways of conceiving testimony through the internal tension they present: while the conception of testimony as a social institution allows us to recognize some fundamental forms of testimony (namely, the testimony of victims of hermeneutic injustice), the definitions of the act of testifying and epistemic dependence seem to exclude them. Far from invalidating Broncano’s analysis, the internal tension, although problematic for cases in which the testimonial agent is subject to hermeneutic injustice is, firstly, necessary to understand cases of discursive injustice or testimonial injustice—and, therefore, I do not advocate its rejection?; and, secondly, it highlights the relevance of conceiving testimony as a social institution. Wisdom is considered as an experiential knowledge available to everyman and as the support of intellectual and spiritual life. ArgumentUp until the French Revolution, European mathematics was an “aristocratic” activity, the intellectual pastime of a small circle of men who were convinced they were collaborating on a universal undertaking free of all space-time constraints, as they believed they were ideally in dialogue with the Greek founders and with mathematicians of all languages and eras. The nineteenth century saw its transformation into a “democratic” but also “patriotic” activity: the dominant tendency, as shown by recent research to analyze this transformation, seems (...) to be the national one, albeit accompanied by numerous analogies from the point of view of the processes of national evolution, possibly staggered in time. Nevertheless, the very homogeneity of the individual national processes leads us to view mathematics in the context of the national-universal tension that the spread of liberal democracy was subjected to over the past two centuries. In order to analyze national-universal tension in mathematics, viewed as an intellectual undertaking and a profession of the new bourgeois society, it is necessary to investigate whether the network of international communication survived the political, social, and cultural upheavals of the French Revolution and the European wars waged in the early nineteenth century, whether national passions have transformed this network, and if so, in what way. Luigi Cremona's international correspondence indicates that relationships among individuals have been restructured by the force of national membership, but that the universal nature of mathematics has actually been boosted by a vision shared by mathematicians from all countries concerning the role of their discipline in democratic and liberal society as the basis of scientific culture and technological innovation, as well as a basic component of public education. Research on environmental-decision making is usually based on utilitarian models, which imply that people's decisions are only influenced by the outcomes. This research provides evidence for values and moral positions that reflect nonconsequentialist rather than consequentialist views. In doing this, this article refers to “sacred values,” which are values that are seen as not-substitutable and nontradable. Two studies were designed to examine evidence for sacred values and their role on act versus omission choices within the environmental domain. The studies revealed (...) that sacred values were closely associated with preferences for actions, trade-off reluctance, deontological focus, and position of moral universalism. The results suggest that it is important to account for sacred values and nonconsequentialist views in environmental decision-making research. (shrink)

Dienes & Perner argue that the explicit representation of an individual to which a property is attributed requires explicit representation of the attributed property. The reasons for this conclusion are similar to the reasons why another of their conclusions may be considered suspect: A property may be explicit without an explicit representation of an individual or the predication of the property to an individual. We question the latter conclusion and draw connections to neurophysiological and cognitive evidence.

Managing the relationship with nongovernmental organizations (NGOs) is a key capability for most companies, because dialogue with stakeholders is a requested feature of Corporate Social Responsibility (CSR). This paper analyses the relationship between businesses and NGOs in Spain. By applying grounded theory, the authors summarize this relationship in the dynamics of conflict and cooperation. NGOs' strategies vis-à-vis companies are categorized and the variables explaining different approaches on both companies' and NGOs' side are examined. The paper concludes by placing the private (...) relationship with NGOs in a wider context (the public arena), dominated by the approach-withdrawal dynamics between firms and NGOs. The aim of this study is twofold: one, to determine the presence and function of scientific knowledge when it is required by such cases as `mad cow' disease, when the crisis breaks in the press; and two, to explore the role of scientific information through the analysis of quoted speech used by journalists in their discourse. Citation is the most explicit form of inclusion of other-discourse in one's-discourse. Within the framework of the theory of énonciation, in combination with a critical (...) view of discourse, we analyse the following: the identity of agents of reference chosen by journalists; the specific linguistic choices made in the pre-citation segment where the agents are introduced, that is, identification of discourse procedures and use of specific verbs of communication. The study shows the proportion of scientific and non-scientific voices, the different ways of representing science agents in the process of news communication as well as the use of citation by journal writers not just to confer authority and legitimation to their discourse but to set the scene of the conflict. The scientific role is not presented as a decisive social role capable on its own of reassuring public alarm and journalists fail to secure appropriate credibility for the scientific community. Este artículo reúne los resultados de nuestra sistematización de las magnitudes físicas y de las expresiones matemáticas de los aparatos formales de la mecánica clásica, relativista y cuántica, revelando su estructura subyacente común. La sistematización se ha realizado ordenando en tablas algunas de las magnitudes físicas y expresiones matemáticas más conocidas según sus diferentes grados de derivación, abriendo paso, de este modo, a un criterio de fundamentalidad de las leyes, principios, postulados y ecuaciones de cada aparato formal.

Gene editing techniques, such as CRISPR, are being heralded as powerful new tools for delivering agricultural products and foods with a variety of beneficial traits quickly, easily, and cheaply. Proponents are concerned, however, about whether the public will accept the new technology and that excessive regulatory oversight could limit the technology’s potential. In this paper, we draw on the sociotechnical imaginaries literature to examine how proponents are imagining the potential benefits and risks of gene editing technologies within agriculture. We derive (...) our data from a content analysis of public comments submitted to the Food and Drug Administration’s 2017 docket titled “Genome Editing in New Plant Varieties Used for Food.” Our sample frame consists of 26 comments representing 30 agriculture and biotech companies, organizations, and trade associations. Our findings reveal three key sociotechnical imaginaries, including that gene editing technologies in agriculture: are not GMO but instead equivalent to traditional plant breeding; have the potential to usher in a new Green Revolution; and could facilitate the democratization of agricultural biotechnologies. We argue that forming and projecting these collective interpretations of the potential of gene editing technologies for crops and foods plays an important role in efforts by proponents to influence regulatory oversight, modes of governance, and build public acceptance. This research contributes to calls by science and technology studies scholars to investigate emergent concerns and imaginaries for novel technoscientific advances to help inform upstream models of public engagement and governance decisions. Besides their practical use, threads, nodes and tissues must have been quickly charged with symbolic meanings. _María Zambrano. __A Life of Poetic Reason and Political Commitment _de Beatriz Caballero Rodríguez y _The Cultural Legacy of María Zambrano_, editado por Xon de Ros y Daniela Omlor, son dos recientes aportaciones críticas al pensamiento de María Zambrano, pioneras en su contexto al constituir los dos primeros libros monográficos en lengua inglesa sobre esta filósofa y escritora. Por ello se abordarán en una reseña conjunta con el fin de mostrar la vigencia del pensamiento de Zambrano en el siglo XXI.

There are no moral entitlements with respect to pollution prior to legal conventions that establish them, or so I will argue. While some moral entitlements precede legal conventions, pollution is part of a category of harms against interests that stands apart in this regard. More specifically, pollution is a problematic type of harm that creates liability only under certain conditions. Human interactions lead to harm and to the invasion of others’ space regularly, and therefore we need an account of undue (...) harm as a basis of assigning legal protections and obligations to different agents, which creates standards for holding those agents responsible for harm. Absent such positive standards with respect to pollution at the domestic or international level, it does not make sense to hold agents responsible. This fact has two fundamental implications. First, contrary to what some defenders of environmental justice argue, we cannot hold people responsible for polluting without a system of legal rights in place that assigns entitlements, protections, and obligations, and second, contrary to what opponents of environmental regulation claim, the lack of moral entitlements to pollute creates room for quite extensive legal restrictions on people’s ability to pollute for the sake of the environment and human health. Indeed the scope of those restrictions is wide and open-ended. (shrink)

El presente monográfico recoge trabajos en torno al tema que da título al mismo: “Teorías de la justicia y tribunales internacionales de derechos humanos”. Dos son las consideraciones que, de entrada, deben hacerse sobre el mismo.

La eterna cuestión de la justicia ocupa un lugar central en la cosmovisión que Dante expresa alegórica e icónicamente en la Divina Comedia. La encontramos como atributo de Dios que da a cada uno según sus méritos, pero cuyo Amor le mueve a conmiserarse de los hombres, pues la justicia de las obras humanas no puede alcanzar a su Creador según igualdad, ni puede a restituir todo lo que de Él recibe y le es debido. La justicia también traspasa todos (...) los círculos por los que transita el peregrinar de Dante y da razones del estado de las aquellas almas que encuentra no sólo en el infierno, sino también en el purgatorio, en el limbo y en el paraíso. Un análisis global de la justicia dantiana pone a la luz la profunda huella de la tradición teológico-bíblica cristiana, de la filosofía clásica —sobre todo aristotélica—, así como la síntesis de ambas en el legado de Santo Tomás de Aquino, a quien Dante destaca entre los sabios del Paraíso —adelantándose así al que, unos años después, será el parecer de la propia Iglesia. Dante Alighieri hace suyo el magisterio filosófico-moral de Santo Tomás y ello se pone muy de manifiesto en lo que se refiere a la concepción dantiana de la justicia. (shrink)
